stores, is joining forces with Microsoft Corp. to offer customers a

Major Australian online music stores have "failed
miserably" in selling music to the public, according to music analyst Phil
Tripp. Tripp said Telstra's BigPond, ninemsn and Destra have not succeeded
in attracting Australian music fans to buying licensed music online
because of a lack of marketing."They are not marketing it to the public.
There are no advertisements you can see on music downloading. They do not
make it a pleasurable experience for users. Most people who try it once

Mindawn is claimed to provide CD-quality song files and 'virtually no'

Court quashes Ottawa's MP3 fee ...
Consumers may soon be paying less for MP3 players
after the Federal Court of Appeal ruled that special copyright levies
applied to digital music players are not legal. A 71-page decision by Mr.
Justice Marc Noël found that although the Copyright Board of Canada was
seeking to protect music writers and performers from the "harm" caused by
digital copying of music when it imposed the MP3 levies last December, the
board did not have the legislative authority to do so. Canada's Copyright
Act gives the federal board the authority to apply levies on blank media
such as compact discs and audio cassettes. But the wording of the act has
not kept up with the new technology of MP3 players, represented by the
wildly popular iPod, which use an embedded memory rather than discs or
cassettes, to store digital copies of songs.

iTunes Music Store Downloads Hit 200 Million, Apple Says ...
Apple Computer announced Thursday that iPod users
have purchased and downloaded more than 200 million songs from the iTunes
Music Store since its launch in April of 2003. The 200 millionth song
downloaded was part of 'The Complete U2' collection and was purchased by

next year, launching an own-brand service on the back of mobile content
delivery company Dwango Mobile. The announcement comes after US market
watcher PJ McNealy of American Technology Research (ATR) downgraded parent
company Roxio's stock from Hold to Sell. The Dwango deal will see the
formation next year of Napster Mobile, a service pitched at North American
consumers, initially selling ringtones, but presumably with music
downloads in mind when the bandwidth's there to make it practical.

released research from global marketing research firm Ipsos-Insight.
iTunes And Napster 2.0 Current Leaders. New findings from TEMPO, the
company's quarterly study of digital music behaviors, reveal that in
summer 2004, American downloaders aged 12 and older were equally as likely
to be aware of Napster 2.0 and Apple's iTunes on a top-of-mind basis (20%
each). However, when prompted with brand names, more than four out of five
(79%) downloaders recognize the Napster 2.0 brand, while nearly half (46%)
are aware of iTunes.

Interia.pl and Wirtualna Polska are in the process of launching legal
music download services for Polish users. Interia has started selling
music via the Melo.pl site, offering some 2,000 tracks from Polish
composers. Users may download tracks for €0.34 (PLN1.49), and whole albums
for a starting price of €2.30 (PLN9.99). Songs are protected with DRM
technology that allows users unlimited listening on two computers.

Sony's move to support the MP3 audio format natively
on its hard drive-based music players will be extended to the recently

Vaio Pocket device, The Register can confirm. According to the
Japanese giant, it will ship a firmware update later this month that will
not only enable native MP3 playback, saving the need to convert tracks to ATRAC 3 Plus first, but will improve the machine's performance generally,
add a speed-scroll facility to the UI and - a big improvement this -

Trial to Unmask Kazaa Owners ...
BRISBANE, Australia -- Lawyers representing the major
record labels will name the secretive owners of Sharman Networks, the
makers of the Kazaa peer-to-peer software, during a trial in Australia's
federal court that began this week. A music industry insider told Wired
News that the investigation of Sharman -- based in Australia but
registered in the tax haven of Vanuatu -- has revealed its true owners.
The music industry will allege Nikki Hemming, the CEO of Sharman, and
Kevin Bermeister, the CEO of Brilliant Digital Entertainment and Altnet,
own and control the company.

the first time a company has said it has reached that milestone in this
country. Napster UK launched in May this year with a catalogue of around

BT jumps on music download bandwagon ...
BT has jumped on the music download bandwagon after signing
a deal with media management software firm Blueprint to jointly develop a
hosting, management and music distribution service aimed at content
providers. The service aims to allow rights holders, including artists,
writers, publishers and record companies, to host their songs, videos,
ring tones and other digital media files, while allowing direct commercial

Kazaa will let users make free phone calls anywhere in the world. Kazaa is
including Skype's Voice over Internet Protocol software in version 3.0 of
its software. According to Kazaa, 300m people have downloaded its
software: it says it is the first peer-to-peer company to offer VoIP
calls. Skype uses internet networks to route calls far more cheaply than
traditional telcos.

long way since we were loading bulky four and eight-track tape systems.
Currently the most convenient way to store music is in an MP3 file: a
compressed version of the original audio file (up to 12 times smaller) for
easy transfer over mediums such as the internet, with minimal degradation
to quality. Toyota Australia is introducing MP3-compatible audio systems
as standard to most of its range. The audio units, manufactured by Fujitsu

The recording industry on Thursday filed another
round of copyright infringement lawsuits against people it said were
illegally distributing songs over the Internet. This latest wave of
federal litigation targeted 750 computer users across the nation,
including 25 students at 13 universities, according to the Recording
Industry Association of America, the trade group for the largest music
companies.

software distributor Grokster are working on a new venture that is
expected to offer paid and free song downloads over the Internet, sources
say.Details of the venture, dubbed Mashboxxx, haven't been finalised but
the service would allow users to download promotional versions of songs by
Sony BMG acts at no charge and buy licenced versions, sources familiar
with the venture told The Associated Press on condition of anonymity.

for the Australian music industry, a court was told.A raft of Australian

From gold records to gold MP3s ...
It might not be the same as having a big gold record
on the wall, but the Recording Industry Association of America has issued
its first gold, platinum, and multiplatinum certifications for digital
downloads. The first obvious winner? Outkast's "Hey Ya!" is the only
multiplatinum single so far, with more than 400,000 downloads. Six songs
qualified for platinum, or sales of 200,000 singles, and 45 titles got
gold status, for selling 100,000 songs.

BT ponders music downloads for payphones ...
UK telco BT could soon be selling digital music
through its 70,000 payphones if talks with a major online music provider
prove fruitful. According to a BBC report, the telco wants to allow owners
of portable music players to hook up their devices to modified payphones,
then pay for and download songs.

Sony launches music players with MP3 support ...
Sony has released the first of its digital audio
players to support the popular MP3 format, marking a significant shift in
its music strategy. As expected, the company announced the release in
Europe of two flash-memory-based devices, the Walkman NW-E99 and NW-E95,
which can natively play songs in MP3 and Sony's own Atrac file format. The
move, discussed by the company on Monday, diverges from its previous
position of not supporting MP3 because of its lack of security measures
and susceptibility to easy file sharing.

MP3 site settles for $10 million with RIAA ...
The Recording Industry Association of America has
reached a $10 million legal settlement with a Spanish company that briefly
offered MP3s online for just pennies a song. The trade group on Monday
said four people associated with Puretunes.com, which operated only
briefly in mid-2003, collectively agreed to pay $500,000 in damages, while
the holding company responsible for the Web site's operations will be
responsible for $10 million.

month old, are we learning anything new about the differences between the
legal downloader and the CD single buyer, asks Robin Langford
It could be argued that the download chart got off to a rather
inauspicious start. The first number one, a live version of Westlife's
"Flying without Wings", suggested that this was not going to be the
cutting-edge alternative to the singles chart that many had hoped.

not shown a clear trend,
but at least one recent study reports that people are deleting MP3s faster
than they are downloading them. AAC and WMA, meanwhile, are apparently
gaining market share. Is this evidence that MP3 is being used largely to
sample music rather than for permanent archival and listening purposes?

Report: Legal Music Downloading Reaching Plateau ...
The number of consumers paying for downloads peaked
at 1.3 million in April. Russ Crupnick, vice president of the NPD Group,
said, "Over the 18 months since iTunes launched, paid music download
services have been hoping for huge increases in paying customers; however,
the number actually doing so has declined to about 1 million users per
month."

Music-download business hits flat note ...
A funny thing has happened in the 18 months since
Apple Computer launched its iTunes Music Store, offering legal music
downloads for 99 cents. The number of paying customers has fallen. From a
peak of 1.3 million people in April, the user base is now about 1 million,
according to NPD, a sales-and-marketing research firm.

MP3 losing steam? ...
After years as the unrivaled king of the
digital-media world, the venerable MP3 music format is losing ground to
rival technologies from Microsoft and Apple Computer. MP3 is still the
overwhelming favorite of file traders, but the once-universal format's
popularity has been going quietly but steadily down in personal music
collections for the last year. According to researchers at The NPD Group's
MusicWatch Digital who track the contents of people's hard drives, the
percentage of MP3-formatted songs in digital-music collections has slid
steadily in recent months, down to about 72 percent of people's
collections from about 82 percent a year ago.

NEC Electronics develops MP3, AAC cell phone chip ...
NEC Electronics Corp. will soon begin mass
production of a new chip that will allow cellular telephone handset makers
to integrate MP3 and AAC (Advanced Audio Coding) music player functions,
it said Friday. Several telephones already play MP3 format music files,
while ringtones based on MP3 files are becoming a popular feature in some
markets such as Japan. The NEC Electronics chip is the first that combines
support for MP3 and AAC and is optimized for cellular telephone use,
according to the company.

Counterfeit MP3 CDs flood markets ...
MANGALORE: The flip side of technology has done it
again. After fake audio cassettes and compact discs, it is MP3 CDs that
are cutting into the revenues of audio stores in Mangalore. Counterfeit
CDs which have a huge market in the City have reduced the meager profits
of shops which deal in audio cassettes and CDs. ‘‘Because of smuggled MP3
CDs, our business of original cassettes and CDs has come down by 25 to 30
per cent. A MP3 CD is being sold at Rs. 40 which includes CD cost of Rs.
11 and recording cost of Rs. 10 and the rest goes to the person who sells
and produces it,’’ says Pundalik Nayak of Melody House, one of the oldest
music stores in the city.

Microsoft Corp. will begin its music download
service in Japan with an initial offering of 50,000 songs, a spokeswoman
for the U.S. software giant's online service unit said Wednesday. The
Japanese version of MSN Music, which launched in test form last month and
went officially live Tuesday in the United States, will start here Oct.
20, offering music from more than 10 recording companies.
